- You must be able to form a binding contract to use the Services.
- If you create an account, you are responsible for keeping it secure and for all activity under it.
3) Scope of Services & Brokerage Disclosures
- Information on listings, specifications, pricing, or availability is provided in good faith but not guaranteed. All offerings are subject to prior sale, change, or withdrawal without notice.
- Valuations and market opinions are estimates and not appraisals or legal/financial advice.
- Transactions may involve third parties (sellers, buyers, surveyors, lenders, documentation agents). We are not responsible for third-party acts or omissions.
4) User Content
You are responsible for content you submit (forms, inquiries, documents). Do not submit anything illegal, infringing, or confidential unless you intend for us to receive it. You grant us a non-exclusive license to use submitted content to provide the Services.
5) Prohibited Uses
- Interfering with site operation or security.
- Scraping, bulk data harvesting, or automated access without permission.
- Uploading malware, or violating others’ rights.
6) Fees & Payments
Commissions, retainers, and closing costs (if any) are defined in a separate written agreement and control in case of conflict with these Terms.

The site design, text, graphics, logos, and other materials are our property or used with permission. You may not copy, modify, or distribute them except for personal, non-commercial use or as otherwise permitted in writing.

10) Limitation of Liability
To the fullest extent permitted by law, Florida Yachtmasters and its officers, employees, and agents shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities. Our total liability for any claim arising from or relating to the Services shall not exceed one hundred U.S. dollars (US$100) or the amount you paid us for the Services giving rise to the claim, whichever is greater.

You agree to defend, indemnify, and hold us harmless from claims or demands arising out of your use of the Services or violation of these Terms.
12) Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to conflicts of law. Exclusive venue and jurisdiction lie in state or federal courts located in Florida, USA, and you consent to personal jurisdiction there.
13) Termination
We may suspend or terminate access to the Services at any time, including for violation of these Terms. Sections that by nature should survive termination will survive.
14) Changes to These Terms
We may update these Terms from time to time. The “Effective date” above reflects the latest version. Continued use of the Services constitutes acceptance of the revised Terms.

Your use of the Services is also governed by our Privacy Policy.
16) Electronic Communications
By contacting us through the site, you consent to receive electronic communications from us and agree that such communications satisfy any legal requirement that communications be in writing.
17) Force Majeure
We will not be liable for delays or failures caused by events beyond our reasonable control.
